Introduction

The Cole Royal Commission into the Building and Construction Industry led to significant reform in industrial relations within the building and constrution industry.

Participants in the industry are now required to comply with statutory obligations that are industry specific, in addition to industrial relations laws that apply generally.

Course Outline

This course examines the specific statutory obligations that apply to the building and constrution industry.  The focus is on employer compliance and how this is achieved in a practical way, particularly in SME's.

The topics to be covered include:

  • General overview of role of ABCC: coverage of Building and Construction Industry Improvement Act 2005
  • Right of entry for permit holders: pre-conditions for entry and on-site behaviour;
  • The National Code of Practice for the Construction Industry and Implementation Guidelines: application and  compliance;
  • Modern award system, the Building and Construction General On-site Award 2010 and interaction with enterprise agreements;
  • Independent contractors: managing contractors and avoiding sham contracting arrangments;
  • Unlawful pressure and coercion;
  • Freedom of assocication;
  • Overview of model WHS Act, Regulations and relevant Codes of Practice;

Learning Style

The course is taught by a combination of seminar style sessions and case studies.

Each participant will be provided with a Training Handbook, which contains all material covered in the course.
